Judge Upholds Using Driving Record to Determine Insurance Rates

A Sacramento judge has thrown out a lawsuit challenging regulations that require auto insurers to base their rates primarily on motorists' driving records instead of where they
live.

Superior Court Judge Loren McMaster granted a summary judgment Thursday, ruling that regulations adopted last year by the state
insurance commissioner were consistent with Proposition 103. That's the rate-regulation initiative adopted by voters in 1998.

Consumer groups are cheering the decision, saying it will mean lower rates for good drivers.

But an insurance industry representative contends the regulations will result in higher rates for suburban and rural residents.

He said insurers are debating whether to appeal.

I recall not too long ago at least two insurance companies were planning on complying with a law that has been in effect, but not enforced, for quite some time... It's probably still some time off w/ all the appeals we're sure to see...

I'm really looking forward to this being a reality! Here's why: My commute is now 3.5mi each way, basically down one main road. It used to be over 14mi each way, down some of the busiest roads in the area, crossing freeways, etc. I have never been at fault in an accident and have no points on my record. Yet when we moved closer to work, but changed zip codes, our rates went up.

Just because, as it was explained to me by a rep from our insurance company, some other area w/in our zip code, outside of our safe neighborhood, may have at some time experienced more crime than the other zip code, the insurance company can justify hiking up our rates.

How in the world is that logical? I think we can all agree it's not fair, but who was the genius who thought gee, that's reasonable, in fact, I think it's a great idea and people will love it!

I think that the driving record should determine the rate in which one person pays not as a general. You should have to pay a little more if you are not properly paying attention or often fail to obey the laws.

I think that people who make the effort to be better drivers and pay attention should have lower rates than those who do not. Not an even board rate amount for.
